Effective date: October 7, 2026
These Terms of Service (“Terms”) are a contract between you and in8development, Inc., a Washington corporation (“in8development,” “we,” “us,” or “our”). They govern your use of in8development.com and the other pages we operate (the “Site”), CITE software, and related support. Investigative and other professional services are governed by a separate written agreement when one is signed. These Terms still apply to the Site and to any subject the signed agreement does not cover.
If you use the Site or CITE for an organization, you represent that you have authority to bind that organization, and “you” includes the organization.
1. Acceptance
By using the Site, requesting a trial, installing or using CITE, creating an account, or clicking to accept these Terms, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or CITE.
An order form, statement of work, or data processing addendum that we both sign controls over these Terms if they conflict on the same subject. A purchase order or vendor portal you send us does not change these Terms unless we sign it.
2. Who we are
in8development, Inc.
Newman Lake, Washington, United States
contact@in8development.com
CITE: cite@in8development.com
Investigative services: investigations@in8development.com
We are not a law firm. Nothing on the Site, in CITE, or in our services is legal advice, and using them does not create an attorney-client relationship.
3. Eligibility
You must be at least 18 years old, or have a parent, guardian, school, or other authorized organization accept these Terms for you. The Site and CITE are not directed to children under 13.
4. The Site
The Site describes our software and services. We may change, suspend, or remove Site content at any time. Submitting a contact form, requesting a demo, or emailing us does not create an investigative, consulting, expert-witness, confidential, or attorney-client relationship. Do not send confidential, privileged, or sensitive matter information until we have both signed an engagement agreement.
5. Accounts
You are responsible for the accuracy of account information, for keeping credentials confidential, and for activity under your account. Notify us promptly at cite@in8development.com if you believe an account has been compromised. We may suspend an account that is inactive, unpaid, or used in violation of these Terms.
6. CITE license
CITE is licensed, not sold. If you have a current trial or paid subscription, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use CITE for your internal professional work during the subscription term, within the user and plan limits in your order or on the pricing page. License keys are issued and validated through Cryptolens. You must keep your license key confidential and use it only for the seats and machines your plan allows.
You will not:
- copy CITE except for a reasonable number of backup copies;
- rent, lease, lend, sell, sublicense, or host CITE for third parties;
- reverse engineer, decompile, or attempt to extract source code, except to the limited extent applicable law forbids this restriction;
- bypass technical limits, licensing controls (including Cryptolens activation limits), permissions, or audit features;
- use CITE to build a competing product or to benchmark it for publication without our written consent; or
- remove proprietary notices.
We and our licensors retain all right, title, and interest in CITE, including all intellectual property rights. These Terms do not grant you any right we do not expressly state.
7. Trials and student access
A free trial, when offered, is for evaluation. The current public trial is four months and includes the features of the standard plan, unless we state otherwise at signup. A trial does not convert to a paid subscription, and we will not charge you, unless you affirmatively subscribe after we have disclosed the price, billing period, and renewal terms.
We may end or refuse a trial for misuse, suspected fraud, or a violation of these Terms. We may change or withdraw the trial offer for new signups at any time.
A student license is free, personal, and non-commercial, and it lasts only while we have accepted your student status. We may ask for reasonable proof of enrollment. A student license that is shared, used for paid client work, or obtained with false information may be revoked.
8. Fees, renewal, and taxes
Paid plans are billed at the price shown at signup or in a signed order. Standard plan pricing published on the Site is monthly or annual. Enterprise terms are quoted separately.
Unless your order says otherwise, a paid subscription renews for successive periods of the same length. We charge the then-current fee at the start of each renewal period unless you cancel before the renewal date. We will disclose automatic renewal before you subscribe. Where the law requires a renewal reminder, we will send it to the billing email we have on file.
Fees are stated in U.S. dollars unless an order says otherwise. You are responsible for applicable taxes other than taxes on our net income. We may collect those taxes where we are required to do so. If a payment fails, we may suspend CITE until the account is current.
9. Cancellation
You may cancel a subscription by emailing cite@in8development.com from the billing contact’s email address. If CITE provides an in-product cancellation control, you may use that as well. Cancellation stops the next renewal. You keep access through the end of the period you have already paid for. Canceling does not delete Customer Content stored on your systems.
10. Refunds
The free trial is the evaluation period. Fees already paid are non-refundable, except:
- where applicable law requires a refund;
- where we agree in writing; or
- if we materially fail to provide the paid CITE service and do not cure that failure within 30 days after your written notice, in which case you may terminate the affected subscription and receive a pro-rata refund of prepaid unused fees for that subscription.
Professional-service fees, retainers, and expenses are handled in the engagement agreement. Completed work and non-cancelable third-party costs are not refundable unless that agreement says they are.
11. Customer Content
“Customer Content” means source materials, notes, reports, comments, and other data you or your users submit to CITE or send to us for support or an engagement.
You keep all right, title, and interest in Customer Content. You grant us a limited license to use Customer Content only as needed to provide support you request, perform a signed engagement, secure our systems, and comply with law. This license ends when the content is deleted from our systems, except for copies we must keep for legal, security, or backup-rotation reasons.
You represent that you have the rights and any required notices or consents to provide Customer Content, and that providing it does not violate law or anyone else’s rights. You are responsible for backing up Customer Content in your CITE workspace.
We do not use Customer Content to train generalized artificial-intelligence models, and we do not sell it.
12. Acceptable use
You will not use the Site or CITE to:
- break the law, including privacy, surveillance, export, sanctions, and intellectual-property laws;
- process personal information about other people without a lawful basis;
- upload malware or interfere with the Site, CITE, or another customer’s environment;
- probe or scan our systems except through the vulnerability-reporting process on the Security page;
- misrepresent the origin of a report or present unverified AI output as source-supported fact; or
- resell access to CITE or share logins outside the licensed organization.
You are responsible for reviewing citations, hashes, AI output, and final reports before you rely on them or deliver them to a client, a court, or another third party.
13. AI features
CITE lets you connect AI tools you choose, such as tools from OpenAI, Microsoft, Google, or Anthropic. Those providers are not our subcontractors merely because you connect them. Content you send them is governed by your agreement with that provider. You decide whether a given source, excerpt, or prompt is appropriate to send. CITE works without an AI connection.
AI output can be wrong or incomplete. It is not a source document. You must check it against the underlying record before you rely on it.
14. Investigative and professional services
Crypto tracing, financial-crime and forensic analysis, litigation support, expert witness work, and other advisory services begin only when both parties sign a written engagement. Until then, information you send us is not confidential by contract, and we may decline the work.
Our work identifies and documents what the available record supports. We do not guarantee a recovery, a legal outcome, an expert opinion a tribunal will accept, or that every fact can be proved. Blockchain and financial analysis depends on the records available and can be limited by incomplete data, off-chain activity, and mixing or other obfuscation.
Unless the engagement agreement says otherwise, after you pay in full you own the final deliverables prepared specifically for that engagement. We keep our pre-existing materials, methods, templates, software, and know-how, and we grant you a perpetual, non-exclusive license to use those items as they are embedded in the deliverables. We may withdraw before an engagement starts, and we may stop work if a conflict appears or if continuing would violate the law or the engagement agreement.
15. Support
Plan support is described on the Site or in the order. Support does not include recovering Content from systems we do not host, custom development, or expert investigative work. Those require a separate agreement.
16. Confidentiality
Each party may receive non-public information from the other. The receiving party will use that information only to perform under these Terms or a signed agreement, protect it with reasonable care, and disclose it only to people who need it and are bound to protect it. Customer Content we receive is confidential information.
These duties do not apply to information that is public through no fault of the receiver, was already known without a duty of confidence, is independently developed, or is rightfully received from someone else. A party may disclose information if law or legal process requires it, after giving notice if legally allowed so the other party can seek protection.
These duties last for five years after disclosure. They last for as long as a trade secret remains a trade secret. On request, the receiver will return or delete confidential information still in its possession, except for records it must keep for legal, security, or ordinary backup rotation.
17. Privacy and security
Our Privacy Policy explains how we handle personal information. Our Security page describes the measures we publish for the Site and for information customers send to us. You are responsible for the security of systems where you install CITE, for who you authorize, and for what you upload or connect to an AI tool.
18. Intellectual property and feedback
The Site, the in8development name and logo, CITE, and our templates and documentation are owned by in8development or our licensors. You may not use our marks without written permission. You may link to the public Site in a fair and accurate way.
If you send suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you. We do not claim ownership of your Customer Content because you give feedback.
19. Third-party services
The Site and CITE may refer to or interoperate with third-party services, including AI tools, file sources, and payment processors. Those services are governed by their own terms. We are not responsible for third-party services we do not control.
20. Disclaimers
THE SITE AND CITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CITE OR THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CITATIONS, HASHES, AUDIT LOGS, OR AI OUTPUT WILL MEET A PARTICULAR EVIDENTIARY STANDARD.
Some jurisdictions do not allow certain disclaimers. In those jurisdictions, the disclaimers apply only to the extent permitted by law.
21. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, COVER, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.
EXCEPT FOR THE EXCLUSIONS BELOW, EACH PARTY’S TOTAL LIABILITY ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR CITE IN THE 12 MONTHS BEFORE THE CLAIM. IF YOU PAID NOTHING, THE CAP IS 100 U.S. DOLLARS.
These limits do not apply to a party’s infringement of the other’s intellectual property, your breach of the license or acceptable-use rules, your payment obligations, a party’s fraud, or liability that cannot be limited under applicable law, including for gross negligence or willful misconduct where the law does not allow that limit.
Professional-service liability is capped in the engagement agreement. If that agreement is silent, the cap is the fees you paid us for the engagement giving rise to the claim.
22. Indemnity
You will defend and indemnify in8development and its directors, officers, employees, and contractors against third-party claims, damages, and reasonable attorneys’ fees arising from Customer Content, your unlawful use of CITE or the Site, or your delivery of work product to a third party.
We will defend you against a third-party claim that unmodified CITE, as we supplied it, infringes a U.S. patent, copyright, or trademark, and we will pay damages finally awarded or a settlement we approve. This duty does not apply to claims arising from Customer Content, AI output, combinations we did not supply, or use after we told you to stop. If a claim arises, we may obtain a right for you to keep using CITE, modify CITE, or terminate the affected license and refund prepaid unused fees. This section is your exclusive remedy for an intellectual-property claim against CITE.
The indemnified party must give prompt notice, reasonable cooperation, and sole control of the defense and settlement. A settlement that admits fault or imposes an obligation on the indemnified party requires that party’s consent, not to be unreasonably withheld.
23. Suspension and termination
You may stop using CITE at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay, or create a security risk. Where reasonable, we will give notice and a chance to cure. We may suspend immediately if needed to stop harm, unlawful activity, or a security incident.
When these Terms end, the license ends and you will stop using CITE. Sections that by their nature should survive do survive, including Customer Content ownership, confidentiality, disclaimers, liability limits, indemnity, and governing law.
24. Export and sanctions
CITE and the Site are subject to U.S. export and sanctions laws. You represent that you are not on a U.S. government restricted-party list and are not located in an embargoed jurisdiction, and that you will not export, re-export, or transfer CITE in violation of those laws.
25. U.S. Government rights
CITE and its documentation are “commercial computer software” and “commercial computer software documentation.” U.S. Government users receive only the rights granted to other customers under these Terms.
26. Copyright complaints
If you believe material on the Site infringes your copyright, email contact@in8development.com with the subject “Copyright complaint.” Include your contact information, a description of the work, the URL of the material, a statement that you have a good-faith belief the use is not authorized, a statement that the notice is accurate and that you are the owner or an authorized agent, and your physical or electronic signature. We may remove material and, where appropriate, terminate repeat infringers.
27. Changes to these Terms
We may update these Terms by posting a new version on this page and changing the effective date. If a change is material, we will provide additional notice, such as an email to account holders or a notice on the Site, before the change applies to you. If you continue to use CITE after the effective date, you agree to the updated Terms. If you do not agree, cancel before that date. Changes do not apply retroactively to a dispute that has already arisen.
28. Governing law and disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before filing a claim, the party will email the other a short description of the dispute and try in good faith to resolve it for 30 days. If it is not resolved, the state and federal courts located in Spokane County, Washington have exclusive jurisdiction, and each party consents to personal jurisdiction there. Either party may seek temporary injunctive relief in a court of competent jurisdiction for misuse of intellectual property or confidential information.
Consumers may have non-waivable rights to bring claims in their home forum. Nothing in these Terms limits those rights.
29. General
These Terms, together with the Privacy Policy, any signed order, and any signed engagement agreement or data processing addendum, are the entire agreement on their subject. A failure to enforce a provision is not a waiver. If a provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent, except to a successor in connection with a merger or sale of substantially all of your assets, with notice to us. We may assign these Terms to an affiliate or successor. We are not liable for delay caused by events outside our reasonable control. Notices to us must be sent to contact@in8development.com. Notices to you may be sent to the email address on your account.
